Introduction

This Privacy and Cookie policy (“Policy”) is used by TimeBlndr B.V. (“TimeBlndr”), with statutory seat in Ede, registered in the trade register of the Chamber of Commerce under registration number 88917851. TimeBlndr can be reached on info@TimeBlndr.com.

This Policy consists of two sections:

Section A: the processing of Personal data, and
Section B: the use of Cookies.

Section A is intended to explain why and how data that identifies or could identify natural people (“Personal data”) is processed by TimeBlndr by means of, for example, the booking platform (“Platform”). Unless indicated otherwise, TimeBlndr is the ‘controller’ as referred to in the General Data Protection Regulation (“GDPR”) for the processing of Personal data as further explained in this Policy.

Section B is intended to inform you about the use of cookies and similar technologies on the Websites of TimeBlndr (hereinafter: “Website”) as maintained by TimeBlndr.

Section A — Privacy and protection of Personal data

1. Personal data

1.1. TimeBlndr may process Personal data in the following cases:

You are a user of the Platform, for example by booking an appointment with the organizer (“Organizer”) through the TimeBlndr Platform;
You are a customer of TimeBlndr (Organizer);
You are a prospective customer of TimeBlndr;
You are a supplier of products and/or services to TimeBlndr;
You are applying for a job at TimeBlndr or otherwise work for TimeBlndr.

1.2. The Personal data that TimeBlndr may process include, among other things: first and last name, contact details, address details, gender, date of birth/age, email address, and additional Personal data, depending on the process you go through.

1.3. In addition to this Personal data, it is possible that you provide us with other Personal data when you contact us. This concerns the following categories of Personal data: the Personal data you provide to TimeBlndr in the course of the performance of the services we provide to you, such as, among other things but not limited to, the (special) Personal data that may be needed to further identify you; and the Personal data TimeBlndr obtains when you use our Website, when you contact us, or otherwise communicate with us, whether in a personal capacity or on behalf of a company.

1.4. When you book an appointment through the Platform, you may be asked to fill in additional personal data, including for appointments you make on behalf of others. TimeBlndr is not the controller with regard to this Personal data. Since the Organizer determines which data is needed for the appointment, and therefore determines the purpose and means of this processing, the Organizer is considered the controller in these cases. We therefore recommend that you consult the Organizer’s privacy statement in these cases for more information about the processing of your Personal data.

2. Sources

2.1. In principle, it is the user of the Platform who provides Personal data to TimeBlndr through the Platform. It is also possible that an Organizer transfers Personal data to TimeBlndr, which means that TimeBlndr does not receive this Personal data directly from you. TimeBlndr obtains your Personal data directly from you if: you use the Platform; you book an appointment through an Organizer via the Platform; you apply for a job at TimeBlndr; or if you fill in the contact form on our Website to receive the newsletter.

3. Legal bases for processing

3.1. TimeBlndr is an independent controller and determines the purposes and means of the processing of Personal data itself, unless indicated otherwise in this Policy. TimeBlndr bases the processing of your Personal data on one of the following legal grounds: the processing is necessary for the purposes of the legitimate interests pursued by TimeBlndr, or a third party, for example TimeBlndr’s interest in analyzing the use of its Platform and producing (pseudonymized) statistics on the booking of appointments — except where the interests or fundamental rights and freedoms of the data subject override the aforementioned interests of TimeBlndr, which may in particular be the case where the data subject is a minor; or, where required, you will always be asked for consent for the processing of your Personal data.

4. Purposes

4.1. As controller, TimeBlndr determines the purposes and means of the processing. TimeBlndr has the following purposes for the processing of Personal data: to enable TimeBlndr to analyze the use of its Platform and make booking appointments easier for you; to enable TimeBlndr to recruit new employees; to enable TimeBlndr to identify you; and to enable TimeBlndr to offer a Platform to users through an Account.

4.2. If Personal data is not provided, TimeBlndr may not be able to perform its services or obligations properly.

5. Retention

5.1. TimeBlndr does not retain the collected Personal data for longer than necessary for the purpose for which this Personal data was originally collected. In addition, TimeBlndr may be obliged under laws and regulations to retain Personal data for a period of two years. TimeBlndr will never retain Personal data for longer, unless TimeBlndr is legally obliged to do so.

6. Recipients and transfer

6.1. TimeBlndr transfers Personal data to third parties, so-called ‘Recipients’, if this is necessary to give effect to the purposes determined by the controller and set out in this Policy. The (categories of) Recipients of Personal data are: our suppliers, including, but not limited to, for example cloud hosting providers, CRM services, payment services, email services and analytics services; our business relations such as customers, principals and contractors, for the performance of an agreement with TimeBlndr or in the context of our normal business operations with you; our auditors, legal advisors, accountants and other advisors; with regard to our Website: suppliers of tools to analyze the use of our Website, all subject to the provisions set out in our cookie policy; government agencies, judicial bodies, supervisory authorities, law enforcement or intelligence services, where there is a legal obligation to provide personal data to them; and any other Recipients to which you explicitly or implicitly consent in connection with the performance of TimeBlndr’s services to you or the company you work for.

7. Possible recipients and transfer

7.1. In addition to the Recipients referred to in article 6, it is possible that TimeBlndr, in the cases below, makes your Personal data public or accessible; this will always be made known to you in advance by TimeBlndr: if TimeBlndr is obliged to provide Personal data under a statutory obligation, or if this is necessary to properly perform the Policy, the General Terms and Conditions or the agreement with you, or to safeguard the rights, property and freedoms of TimeBlndr or its customers or others.

8. International transfer

8.1. It is possible that third parties located outside the European Economic Area (EEA) gain access to your personal data. In the event of a transfer of personal data for which we are the controller to countries outside the EEA (so-called ’third countries’), we will ensure ‘appropriate safeguards’. More specifically, we contractually oblige recipients of personal data to protect your personal data using Standard Contractual Clauses (SCCs) as approved by the European Commission. Where necessary, and with the assistance of the recipients in third countries, we assess on a case-by-case basis whether the laws, regulations and/or practices of the third country could impede the effectiveness of the SCCs. In those cases, we will take additional measures to eliminate any gaps in protection and bring them up to the level required by EU legislation.

9. Security

9.1. TimeBlndr attaches the greatest importance to the security of your Personal data and therefore takes appropriate measures and safeguards. These measures and safeguards comply with the requirements of the GDPR.

10. Rights

10.1. Depending on the situation and subject to certain conditions, you have the following rights: the right to request the controller to grant access to the Personal data; the right to request the controller to rectify the Personal data; the right to request the controller to erase the Personal data; the right to ask the controller whether the processing of the personal data can be restricted; the right to object to the processing by the controller; the data subject’s right to the portability of personal data; where the processing was based on consent: the right to withdraw this consent at any time, without affecting the lawfulness of the processing before the moment of this withdrawal; and the right to lodge a complaint with the supervisory authority.

10.2. In order to exercise these rights, TimeBlndr may ask for specific additional information. This additional information will only be processed in order to be able to exercise the rights mentioned.

Section B — Cookies

TimeBlender uses cookies on this website. We keep this as limited as possible: only what’s needed to make the site work, plus statistics for which we ask your consent. On this page you can read exactly which cookies we place, why, how long they remain, and how to withdraw your choice.

We use Google Analytics to see how our website is used: which pages are viewed, how visitors arrive at the site, and where they drop off. We use these insights to improve the website. We only place these cookies after you have given consent for this in our cookie notice. If you do not give consent, we measure nothing and the site continues to work as usual.
